Yes, you can sell a home in Abu Dhabi while a tenant lives in it. Under the tenancy law the lease stays in force against the new owner, so the buyer takes over your tenant, the rent and the end date. Selling is not one of the reasons the law gives for asking a tenant to leave early. What makes the sale smooth is a clear written agreement with the tenant on viewings, and a sale agreement that says who receives which rent and the deposit.
What does the law say when a rented home is sold?
Abu Dhabi's tenancy law, Law No. 20 of 2006 as amended, is published on ADREC's rules and regulations page. Three articles matter most to a seller:
- Article 18: if the title to the leased home passes to another person, the tenancy contract is effective against the new landlord.
- Article 19: the new landlord cannot claim from the tenant rent paid in advance to the former landlord, unless he proves the tenant knew of the transfer when paying; otherwise he claims it from the former landlord.
- Article 20: a party who does not want to renew, or wants to change the terms, must tell the other in writing two months before the lease ends for a home, and three months for commercial property.
Can the tenant be asked to leave because I am selling?
Article 23, read with Article 20, lists the only reasons a landlord may ask a tenant to vacate. They include unpaid rent, subletting without permission, misuse of the home, demolition or rebuilding under strict conditions, and the landlord wishing to live in the home. Selling the home is not on that list.
The own-use reason has firm conditions: the landlord must give notice six months before the lease ends, must not own another habitable home in the same municipality, and must actually live there for one uninterrupted year. If the landlord does not, the tenant may be awarded a return to the home or compensation of up to one year's rent. A buyer who wants to move in should read these conditions before signing. For a specific case, take legal advice.
What should I agree with the tenant?
The law does not set rules for viewings, so agree them in writing and keep the tenant on side:
- Viewing days, times and how much notice you give before each one.
- Whether the tenant plans to renew, which tells buyers what they are buying.
- The condition of the home, with dated photos.
- Who holds the deposit, and that it will pass to the buyer.
- Permission to share the lease details and the tenant's contact with the buyer.
If the tenant would rather leave before the end of the lease, put that agreement in writing. A Tawtheeq lease that is still valid can then be cancelled through TAMM's "Cancel a Lease Contract for Leased Property Units" service, which lists no fee and no documents. The tenant must accept the cancellation on DARI; if the tenant rejects it, the landlord can ask for a court order.
What goes in the sale agreement?
- That the home is sold with a tenant, and the Tawtheeq contract number.
- The yearly rent, the payment dates and the cheques still to come.
- Which share of rent already paid belongs to the buyer, and how you settle it.
- The deposit amount and its transfer to the buyer.
- The lease end date and the notice rules above.
Rent is also frozen for now outside ADGM: since 3 June 2026 renewals are at a 0% increase until further notice, and renewals and new agreements both reference the rent in the last registered Tawtheeq contract. A buyer should price your home on today's registered rent. Anyone can check that contract by its number on ADREC's Verify Document page.
How to sell a home with a tenant in it
- Check your Tawtheeq contract: rent, end date and cheques.
- Talk to the tenant and agree viewings and the deposit in writing.
- Sign a brokerage contract with a licensed broker and approve the Madhmoun advertising permit.
- Advertise the home as rented, with the rent and the lease end date.
- Agree the sale, with the lease terms written into the sale agreement.
- Get the developer's No Objection Certificate and register the transfer on DARI or TAMM.
- Introduce the buyer to the tenant and hand over the deposit and the remaining cheques as agreed.
Is it different on Al Reem and Al Maryah Islands?
Yes. Leases on both islands are registered with ADGM on AccessRP and follow ADGM's own rules. ADGM says a tenant cannot be changed during an active lease, and a lease can end early only if both parties approve or with a court order. Ask ADGM's AccessRP support how the lease is handled when the home is sold.

Frequently asked questions
Can I sell my property in Abu Dhabi if it is rented?
Yes. Under Article 18 of Law No. 20 of 2006 the tenancy contract stays effective against the new owner, so the buyer takes over the lease.
Does the tenant have to leave when the home is sold?
No. Selling is not one of the reasons in Article 23 for asking a tenant to vacate. The lease continues with the new owner until it ends or both sides agree otherwise.
Can the new owner move into the home?
Only under the own-use conditions of Article 23: notice six months before the lease ends, no other habitable home in the same municipality, and living there for one uninterrupted year. Take legal advice for your case.
Who keeps the rent the tenant already paid?
Article 19 says the new landlord cannot claim advance rent from the tenant unless the tenant knew of the transfer when paying; he claims it from the former landlord. Settle the split in the sale agreement.
