Rent in 1, 2 or 4 Cheques in Abu Dhabi

Abu Dhabi landlords and tenants often split the yearly rent into cheques agreed at signing. The number is for the two of you to agree: the law leaves the payment dates to your written agreement. What changes with the number is your cash flow, your risk and your paperwork.

Key points

  • The number of cheques is a matter of written agreement between landlord and tenant.
  • One cheque means one date to track; four cheques may suit more tenants but mean more follow up.
  • For a home, rent is due within 21 days of each agreed due date under Law No. 20 of 2006.
  • A receipt for one period counts as proof the earlier ones were paid, so give receipts in order.
  • Record the total rent, deposit, payment method and instalments when you register in DARI.

What each option means for you

ChequesFor youWatch for
1The full year paid at the start, one date to track.Fewer people can pay a year at once, so the search may take longer.
2Two payments, for example at the start and after six months. One later date to follow up.
4A payment every three months; this may suit more tenants.Three later dates, so more chances of a delay to follow up.

What the law says about late rent

Law No. 20 of 2006 sets the rules. For a home, the tenant pays within 21 days of each due date agreed in writing, unless the contract says otherwise. If there is no written agreement on the dates, the rent falls due at the beginning of each month.

If a tenant does not pay within that period, the landlord may ask for eviction. The law also gives a second chance: no eviction is ordered if the tenant pays the rent due and the landlord's legal costs before the dispute is decided. Repeated delay without an acceptable excuse can lead to eviction.

Keep a clear record of what you receive. Under the same law, a receipt for one period is taken as proof that the earlier periods were paid, unless shown otherwise. So never give a receipt for a later cheque while an earlier one is still unpaid.

Rent disputes are heard by the Rental Dispute Settlement Committees of the Abu Dhabi Judicial Department. For leases registered with ADGM on Al Reem and Al Maryah Islands, ADGM's AccessRP explains that a landlord can obtain an order from the ADGM Courts to end the lease.

Record the plan in the lease

When you register the lease in DARI (Tawtheeq), the form asks for the total rent, the deposit, the payment method and the number of instalments. Agree all of these before you register: DARI's Modify service lets you change only the occupants, the amenities and who pays the water and electricity bill, and only in the first 7 days (after that you can only add an occupant). On Al Reem and Al Maryah Islands, ADGM's AccessRP states that rent instalments are a matter of mutual agreement between landlord and tenant.

How to choose your number

  • Do you pay a mortgage or service charge in instalments? More cheques spread over the year can match your own payments.
  • Do you want less follow up? Fewer cheques mean fewer dates to track.
  • Do you want a wider choice of tenants? Being open to more cheques may help.

When you receive the cheques

  • Check each cheque's date, amount, payee name and signature before the tenant leaves.
  • Match the cheques to the schedule in the registered lease.
  • Keep copies and a simple list of due dates.
  • Give a receipt for each payment you accept, in order.
  • Follow up a missed payment in writing, on the same day.
