Owner questions
Do I need an agent to rent out my home?
No. As the landlord, you can register the tenancy contract yourself in DARI, and the tenant then accepts it there. An agent saves you the work: pricing, photos, viewings, tenant checks and the paperwork. Listings on accredited property websites need a Madhmoun permit, which is issued to a licensed broker that you approve. How do I register Tawtheeq, and who pays?
The landlord registers the lease in DARI under Services, Lease, Register Tenancy Contract, and the tenant accepts it. For a home lease under 4 years, DARI lists a service fee of AED 50 per contract. The municipality fee is 5% of the yearly rent, at least AED 450, for tenants who are not UAE nationals, and the contract states whether the tenant or the landlord pays it. On Al Reem and Al Maryah, leases go through ADGM's AccessRP, where the landlord pays the registration fee. We guide you through the registration.
How much notice must I give if I will not renew or want to change the terms?
Two months in writing before the lease ends, for a home. Outside ADGM, Law No. 20 of 2006 on leasing in Abu Dhabi says the party that does not wish to renew, or wishes to change the terms, must notify the other in writing two months before expiry for residential property, and three months for commercial and other business use. Any change to the rent must also follow the current rent rules. Note the date early.
When can I renew the lease, and can I change the tenant?
In DARI, the landlord renews the tenancy contract within the last month before it expires; the tenant cannot start the renewal. You can update the rent, within the current rules, and add occupants, but you cannot replace the tenant on a renewal, so a new tenant needs a new contract. On Al Reem and Al Maryah, AccessRP allows renewal up to 90 days before expiry.
How do I rent out a home on Al Reem or Al Maryah?
These islands are under ADGM, so the lease is registered on the ADGM AccessRP platform, not in DARI. The owner, a representative with power of attorney, or a company managing the home under an active agreement starts the contract, and both landlord and tenant approve it. ADGM says the landlord pays the lease registration fee. On renewal, the yearly rent for a home can rise by no more than 5%. Ask us for a free rent estimate, answered within 24 hours.
Who settles a dispute with my tenant?
Outside ADGM, the Rental Dispute Settlement Committees of the Abu Dhabi Judicial Department hear disputes between landlords and tenants as a matter of urgency, under Law No. 20 of 2006, and each committee is formed of judges. For leases on Al Reem and Al Maryah, ADGM points landlords to the ADGM Courts, for example to end a lease when the tenant does not pay. A clear registered contract and written notices help most.
